Your legal framework
The Health and Safety at Work Act 1974 requires employers to ensure the safety of both employees and members of the public. The Management Regulations 1999 require suitable risk assessments for all activities. Swimming pools are subject to additional guidance from the Royal Life Saving Society. All fitness instructors should hold current first aid certification.
The highest-consequence risks
Equipment failure and misuse
Treadmill, cable and weight-stack failures can cause serious injury. Pre-use inspections, member inductions and out-of-service tagging are all essential.
Wet-side slips and drowning
Poolside and changing areas carry high slip risk. Swimming pools require qualified supervision, appropriate bather ratios and a practised emergency action plan.
Cardiac events during exercise
Gyms should have accessible defibrillators, trained first aiders and a pre-activity health screening process to identify at-risk members.
Legionella in water systems
Pools, showers and spa equipment carry Legionella risk. A written Legionella risk assessment and monitoring scheme is a legal requirement.
Five priorities for fitness and leisure

Implement a documented equipment inspection programme. Daily pre-opening checks, monthly detailed inspections and annual service records for all gym and leisure equipment.

Have a current, practised emergency action plan. All staff must know their role in a cardiac event, serious injury or pool emergency. Regular drills are essential.

Carry out a Legionella risk assessment. A written assessment covering all water systems, with a monitoring and treatment schedule, is required by HSE Approved Code of Practice L8.

Induct all new members on equipment use. A supervised induction reduces equipment misuse injuries and gives you a documented record of instruction.

Screen members before high-intensity activity. A health screening questionnaire for new members, with a referral pathway for those with health conditions, manages both safety and liability.
